Introduction

1. The “Promoter” is O'Brien Glass Industries Limited ABN 74 000 022 275 (“O'Brien”) of Unit 1, 45 Davies Road Padstow NSW 2211.
2. Instructions and information on how to enter form part of the Conditions of Entry.
3. By entering and participating in the O'Brien Road Trip Giveaway Competition (“Promotion”), entrants agree to be bound by these Conditions of Entry.

Promotion Period and Prize Supplier

1. The Promotion commences at 10.00am AEST on 10 June 2025 and concludes at 11.59 pm, AEST on 20 July 2025.
2. The Prizes are supplied by the Promoter.

Eligibility Criteria and How to Enter

1. This competition is open to natural persons who are Australian residents:

a. who are 18 years old;

b. who enters the competition as per clause 9;

c. between 10.00am 10 June and 11.59pm 20 July 2025.

d. who submit an entry in accordance with clause 9 below before 11.59 pm 20 July 2025;

e. who are not ineligible under clause 8.

2. The following persons are ineligible to enter:

a. trade customers;

b. directors, management and the employees of the Promoter and promotional partners, agencies and suppliers associated with this Promotion and the immediate family members of these people;

c. persons aged under 18 years of age.

3. You can only enter the competition once, but you can earn additional entries by completing additional steps as per clause 10.

4. To enter, entrants must follow the steps outlined in the giveaway post:

a. follow @ObrienGlass on Instagram, /obrienaus on Facebook or @OBrienAustralia TikTok, and

b. tag at least one friend in the comments of the giveaway post

5. Entrants can earn additional entries by tagging multiple friends in separate comments (one tag per comment earns one additional entry, no limit on the number of comments).

6. This is a game of chance as the winning entries will be drawn randomly.

7. Meta and TikTok terms and conditions apply, and the Promoter has no responsibility for entries that do not comply with Meta or TikTok policies. Entries that do not comply with Meta or TikTok policies and / or Meta and TikTok terms and conditions are invalid.

8. The entrant acknowledges that the Promotion is not sponsored, endorsed, administered by or associated with Meta or TikTok.

Prizes and Claiming Prizes

1. The first valued entry drawn from all valid entries received will win the following prize:

The total prize is valued at up to $2,362.

2. There will be 1 prize awarded. There are no other prizes.

3. All valid entries will be entered into the random draw. One winner will be drawn, and the Promoter will contact the winner to verify their eligibility.

4. The Promoter will direct message the winner via the platform that they entered on. If within five business days of contact by the Promoter, that entry does not respond, that entry will be discarded, and the prize will be awarded to the next randomly drawn entry.

5. The winner will be published on the O'Brien Facebook & Instagram pages on Monday, July 28, 2025.

6. Prizes will be issued via a Paradise Resort Gold Coast voucher and the fuel component issued as an e-gift card and sent to the winners’ verified email address.

7. Prizes are not transferable unless agreed in advance with the Promoter and at its absolute discretion.

8. Prizes are not exchangeable and cannot be taken as cash.

9. The Promoter draw is final, and no appeal of the decision is possible.

10. If a prize, or element of a prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it.

11. This prize is valid for travel until 31 December 2026 and excludes travel in high and peak periods which includes school holidays. Bookings are subject to availability and vouchers may not be accepted on all dates.

12. This prize includes one kids club session per child.

13. The prize is not transferrable and may not be exchanged for cash. Any unused portion will be forfeited.

14. Vouchers will not be extended past the expiry date.

15. All other expenses will be the responsibility of the prize winner including but not limited to current passports, spending money, transport to and from departure and arrival points, transfers, activities, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs.

16. Travel insurance is not included in the prize but is highly recommended.

General entry provisions

1. This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram or TikTok.

2. The Promoter has no responsibility for any tax implications that may arise from the winning of the prizes. Independent financial advice should be sought.

3. The Promoter, its agencies and companies associated with this Promotion are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrants’ or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion. If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, reserves the right to amend, suspend or cancel the Promotion subject to approval from any relevant authority.

4. The Promoter has the right to disqualify all entries from any entrant who tampers with, or benefits from tampering with, the entry process or the Promotion

5. Nothing in these Conditions of Entry limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees under the Competition and Consumer Act 2010 (CTH) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

6. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury and any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion or any of the following:

a. any human error, technical difficulties or equipment malfunction (whether or not under the Promoter’s control)

b. any fraud, theft, unauthorised access or third-party interference;

c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter ) due to any reason beyond the reasonable control of the Promoter;

d. any variation in prize value to that stated in these Conditions of Entry;

e. any tax liability incurred by a winner or entrant;

f. taking or use of all or part of a prize; or

g. the function, working order or availability of or access to any website.

7. The entrant releases and agrees to keep the Promoter indemnified and held harmless from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by the Promoter arising out of the entrant’s:

a. participation in the Promotion

b. taking or use of all or part of a prize, including utilizing or participating in any benefits associated or connected with the prize; and

c. any claim by a third party arising from an act or omission by the entrant.

8. The entrant releases, indemnifies and holds Facebook, Instagram and TikTok harmless from all and any claims, losses (including indirect and consequential loss), costs, demands, tax, liability, or damage (including legal costs on a full indemnity basis) suffered or incurred by the entrant in relation to this Promotion.

9. The Promoter is not liable for any failure to comply with these Conditions of Entry.

10. If any part or provision in these Conditions of Entry is found to be invalid, void, voidable, unenforceable or illegal, that part or provision will be read down so that it is not invalid, void, voidable, unenforceable or illegal. If the term or condition cannot be read down, it will be severed and the remaining provisions will continue in full force.

11. These Conditions of Entry constitute the entire agreement between the entrant and the Promoter as to its subject matter.

Collection and use of personal information

1. The Promoter may use any personal information entrants provide in connection with this Promotion for the purpose of running the Promotion, and in advertisements, publications, websites, media statements and other promotional material associated with the Promotion. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. Entrants may enter using a pseudonym through Facebook, Instagram or TikTok but must provide address details for delivery of the prize if they are the winner.

2. By participating in the Promotion, each entrant acknowledges and agrees that a further primary purpose for the collection of personal information by the Promoter is to enable the Promoter to contact the entrant in the future in relation to this Promotion. Entry is conditional on providing this information which will be handled in accordance with the Privacy Policy available at https://www.obrien.com.au/privacy-policy/

– Multiple entries are permitted during the promotional period, subject to only one entry permitted per Job completed by O’Brien and issued an “Eligible Job Number” by O’Brien.

For your chance to enter the Minor Instant Prize Draw, entrants must:

– Purchase Bosch Wiper Blades from distributor O'Brien Glass Industries Limited (ABN 74 000 022 275) between 11th May 2023 to 14th of July 2023 .

– Visit http://www.obrien.com.au/winwithwipers, enter contact details and Eligible Job Number issued by O’Brien and Vehicle Registration associated with the Eligible Job Number to enter the Minor Instant Prize Draw. These three data points must match O’Brien records to be valid.

– The Instant Prize will then be displayed on the screen at http://www.obrien.com.au/winwithwipers and an email confirmation will be sent to the email provided. The physical prize will be dispatched to the name and address provided.

– Multiple entries are permitted during the promotional period, subject to only one entry permitted per Eligible Job Number.

6. The Major Prize Draw will take place on 21st of July 2023 at 10.00am (AEST) at 1555 Centre Road, Clayton, VIC, 3168, Australia and the winner will be contacted a week later by the method outlined in item 12.

All eligible entrants who do not win an Instant Prize in the Minor Instant Prize Draw will receive 1 additional entry into the Major Prize Draw.

The total prize pool is $14,104 which is correct at the time of printing.

8. Prizes must be taken as offered and cannot be varied or taken as cash. Subject to legislative approval if any of the prizes (or part of the prizes) is out of stock at the time of redemption, the Promoter reserves the right to substitute the prize (or that part of the prize) with another of equal value. The Promoter accepts no responsibility for any variation in the value of any prize. Any operating, repair or other ancillary costs associated with redeeming a prize are the sole responsibility of each winner.

The Prizes for the Major Prize Draw will be despatched to the winners before the 14th of November 2023 depending on stock availability.

The Prizes for the Minor Instant Prize Draw will be despatched to the winners before the 14th of November 2023 depending on stock availability.

9. The Promoter has the right to exclude any entry to the Major Prize Draw if it determines at any time that the data points do not match O’Brien records, or any error or inconsistency is determined in the entry details, even if a Minor Instant Prize has been won. The entrant must return any Instant Prize to local O’Brien location if Promoter advises entry details do not match O’Brien records.

10. At the conclusion of the Promotion, all existing claims for prizes and entitlements to claims will be met, notwithstanding the advertised prize pool has been exceeded. Any printing errors and other quality control matters outside the control of entrants shall not be used as the sole basis for refusing to award a prize.

11. Subject to any written directions issued by any regulatory authority, any prizes that remain unclaimed 3 months after the Promotional Period will be distributed by way of an unclaimed prize draw. This draw will be made up of all participants who have entered the Promotion.

If required, draw(s) will occur on 20th of November 2023 at 10.00am (AEST).

All winner(s) in the unclaimed prize draw will also be required by the Promoter to provide proof of purchase to be awarded the prize. If proof of purchase cannot be located by the date required by the Promoter, a new draw will be undertaken. Prizes for the unclaimed prize draw will be despatched to the winners by end of October 2023.

12. All prospective winners will be notified by email or telephone. The winners of the Major Prize Draw will be published at www.obrien.com.au on 28th of July 2023. The winners in the second chance draw will be published at www.obrien.com.au on 27th of November 2023.

13. If any prize winner is under the age of 18 years, that prize will be awarded to that person’s parent or guardian.

14. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who enters and no correspondence will be entered into.

15. The Promoter and its associated agencies and companies associated with this Promotion shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this Promotion or any prizes awarded in the course of this Promotion, except for any liability which cannot be excluded by law.

16. The Promoter and its officers, employees and agents will not be responsible for any incorrect, inaccurate or incomplete information received or not received in the course of or in connection with this Promotion if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures.

17. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Conditions of Entry, or engaged in any unlawful or improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

18. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Promotion, subject to the approval of any relevant regulatory authority.

19. At the request of the Promoter, all winners agree (without charge) to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter’s marketing materials.

20. Facebook, YouTube, Instagram, or Snapchat may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, YouTube, Instagram, or Snapchat; and to release Facebook, YouTube, Instagram, or Snapchat from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not Facebook, YouTube, Instagram, or Snapchat.

13. Facebook terms and conditions apply and O'Brien has no responsibility for entries that do not comply with Facebook policies. Entries that do not comply with Facebook policies and / or Facebook terms and conditions are invalid.
14. The entrant acknowledges that the promotion is in no way sponsored, endorsed, administered by or associated with Facebook.
15. All entries become the property of O'Brien and will not be returned. O'Brien may use and may disclose in any newspaper, advertisement, publication, website, media statement or other general and promotional material, any materials entrants provide in relation to the Promotion for O'Brien promotional and business purposes.

Prizes and Claiming Prizes
16. All valid entries will be judged by representatives of O'Brien based upon literary and creative merit, the practicality of production, relevance, brand policies and commercial consequences, as assessed by O'Brien’s representatives in their absolute discretion. The best valid entry, as determined by the judge/s, will be awarded the only prize.
17. Winners will be announced Tuesday 13 December 2022 to win one of ten Australian Cash Stream board games.
18. Results will be published on the O'Brien Facebook page and O'Brien will message the winner via Facebook. If a winning entry is invalid, that entry will be discarded, and the prize will be awarded to the next most deserving entry in the judge’s opinion.
19. The prize is a copy of the Australian Cash Stream board game.
20. There will be 10 major prizes awarded. There are no other prizes.
21. Postage and handling fees within Australia will be included in the prize.
22. Prizes are not transferable unless agreed in advance with O'Brien and at its absolute discretion.
23. Prizes are not exchangeable and cannot be taken as cash.
24. O'Brien judges’ decision is final, and no appeal of the decision is possible.
25. If a prize, or element of a prize, is unavailable for any reason, O'Brien reserves the right to substitute another prize of equal or greater value for that prize, or element of it.
26. Winners must contact O'Brien to accept and claim their prize within 2 days of the judges’ decision being posted on the O'Brien Facebook page. In the event of a prize not being accepted and claimed within 2 days (together with relevant delivery information), the relevant winner’s entry will be deemed invalid, and O'Brien has the right to award the prize to the next most deserving entry.
27. O'Brien may amend or extend this time for contact at its absolute discretion by posting the extension on its Facebook site.

General entry provisions
28. O'Brien has no responsibility for any tax implications that may arise from the winning of the prizes. Independent financial advice should be sought.
29. O'Brien, their agencies and companies associated with this Promotion are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrants’ or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion. If the Promotion is not capable of being conducted due to circumstances beyond O'Brien’s control, including due to any technical or communications problems, O'Brien reserves the right to amend, suspend or cancel the Promotion subject to approval from any relevant authority.
30. O'Brien has the right to disqualify all entries from any entrant who tampers with, or benefits from tampering with, the entry process or the Promotion.
31. Nothing in these Conditions of Entry limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
32. Except for any liability that cannot by law be excluded, O'Brien (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury and any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion or any of the following:
a) any human error, technical difficulties or equipment malfunction (whether or not under Promoter’s control);
b) any fraud, theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Promoter) due to any reason beyond the reasonable control of O'Brien;
d) any variation in prize value to that stated in these Conditions of Entry;
e) any tax liability incurred by a winner or entrant;
f) taking or use of all or part of a prize; or
g) the function, working order or availability of or access to any website.
33. The entrant releases and agrees to keep O'Brien indemnified and held harmless from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by O'Brien arising out of the entrant’s:
a) participation in the Promotion;
b) taking or use of all or part of a prize, including utilizing or participating in any benefits associated or connected with the prize; and
c) any claim by a third party arising from an act or omission by the entrant.

The entrant releases, indemnifies and holds Facebook harmless from all and any claims, losses (including indirect and consequential loss), costs, demands, tax, liability, or damage (including legal costs on a full indemnity basis) suffered or incurred by the entrant in relation to this Promotion.
35. O'Brien is not liable for any failure to comply with these Conditions of Entry.
36. If any part or provision in these Conditions of Entry is found to be invalid, void, voidable, unenforceable or illegal, that part or provision will be read down so that it is not invalid, void, voidable, unenforceable or illegal. If the term or condition cannot be read down, it will be severed and the remaining provisions will continue in full force.
37. These Conditions of Entry constitute the entire agreement between the entrant and O'Brien as to its subject matter.

Collection and use of personal information
38. O'Brien may use any personal information entrants provide in connection with this Promotion for the purpose of running the Promotion, and in advertisements, publications, websites, media statements and other promotional material associated with the Promotion. O'Brien may disclose the information for those purposes to its related bodies corporate and contractors. Entrants may enter using a pseudonym through Facebook but must provide address details for delivery of the prize if they are the winner.
39. By participating in the Promotion, each entrant acknowledges and agrees that a further primary purpose for the collection of personal information by O'Brien is to enable O'Brien to contact the entrant in the future in relation to this Promotion. 8. Prizes must be taken as offered and cannot be varied or taken as cash. Subject to legislative approval if any of the prizes (or part of the prizes) is out of stock at the time of redemption, the Promoter reserves the right to substitute the prize (or that part of the prize) with another of equal value. The Promoter accepts no responsibility for any variation in the value of any prize. Any operating, repair or other ancillary costs associated with redeeming a prize are the sole responsibility of each winner.

The Prize for the Major Prize Draw will be despatched to the winner before end December 2022.

The Prizes for the Minor Instant Prize Draw will be despatched to the winners before end November 2022.

9. At the conclusion of the Promotion, all existing claims for prizes and entitlements to claims will be met, notwithstanding the advertised prize pool has been exceeded. Any printing errors and other quality control matters outside the control of entrants shall not be used as the sole basis for refusing to award a prize.

10. Subject to any written directions issued by any regulatory authority, any prizes (excluding the free Wiper Blade sets) that remain unclaimed 3 months after the Promotional Period will be distributed by way of an unclaimed prize draw. This draw will be made up of all participants who have entered the Promotion.

If required, draw(s) will occur on Monday 14th February 2023 at 10.00 am (AEST).

All winner(s) in the unclaimed prize draw will also be required by the Promoter to provide proof of purchase to be awarded the prize. If proof of purchase cannot be located by the date required by the Promoter, a new draw will be undertaken. Prizes for the unclaimed prize draw will be despatched to the winners in February 2023.

11. All prospective winners will be notified by email or telephone. The winners of the Major Prize Draw will be published at www.obrien.com.au on Monday 14th November 2022. The winners in the second chance draw will be published at www.obrien.com.au on Wednesday 16th February 2023.

12. If any prize winner is under the age of 18 years, that prize will be awarded to that person’s parent or guardian.

13. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who enters and no correspondence will be entered into.

14. The Promoter and its associated agencies and companies associated with this Promotion shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this

The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Promotion, subject to the approval of any relevant regulatory authority.

18. At the request of the Promoter, all winners agree (without charge) to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter’s marketing materials.
